REGWRITER ALERT: Guidance on Compliance with the Congressional Review Act

The memorandum updates OIRA's current process for reviewing rules under the CRA and Executive Order 12866, Regulatory Planning and Review. The memorandum clarifies that OIRA's review will define rules to include both regulations and guidance and that this review will apply to Independent Regulatory Agencies (as defined in the Paperwork Reduction Act) as well as all agencies traditionally covered by EO 12866 review.

 

On Thursday, April 11, 2019, the Office of Management and Budget issued Memorandum "Guidance on Compliance with the Congressional Review Act" addressing review of regulations by the Office of Information and Regulatory Affair (OIRA) under the Congressional Review Act (CRA). The memorandum updates OIRA's current process for reviewing rules under the CRA and Executive Order 12866, Regulatory Planning and Review. The memorandum clarifies that OIRA's review will define rules to include both regulations and guidance and that this review will apply to Independent Regulatory Agencies (as defined in the Paperwork Reduction Act) as well as all agencies traditionally covered by EO 12866 review. The effective date for the memorandum is May 11, 2019.
