This one-day course is designed to help anyone understand and navigate the legal and procedural issues related to agency guidance. Guidance is a broad term that includes agency interpretations, policy statements, letters, and advisory materials issued to supplement or explain agency regulations and statutes. This course explains the difference between various types of guidance documents, what is meant by "binding" versus "non-binding guidance," the spectrum of procedural (Administrative Procedure Act) options agencies have for promulgating guidance, and the levels of judicial deference given to these documents. This course also addresses techniques for writing and organizing guidance documents.
Hours: 8:30 a.m. - 3:30 p.m. EST
