On January 30, 2009, President Obama issued Executive Order (EO) 13497 revoking EOs 13258 and 13422. Executive Orders 13258 and 13422 were issued by President Bush amending EO 12866 "Regulatory Planning and Review." The effect of revoking EOs 13258 and 13422 is to return EO 12866 to its original form as issued by President Clinton on September 30, 1993. Executive Order 13497 also directs the Office of Management and Budget and the heads of executive departments and agencies to "rescind any orders, rules, regulations, guidelines, or policies implementing or enforcing Executive Order 13258 or Executive Order 13422, to the extent consistent with law." Presumably this would include the OMB Bulletin on Good Guidance Practices and the Office of Information and Regulatory Affairs' (OIRA) memorandum on "Implementation of Executive Order 13422." On January 30th the President also issued a memorandum on Regulatory Review which declares the intent of the administration to issue a new EO on rulemaking to replace EO 12866. This memorandum states "I therefore direct the Director of OMB, in consultation with representatives of regulatory agencies, as appropriate, to produce within 100 days a set of recommendations for a new Executive Order on Federal regulatory review."
